What is Sexual Assault?
Sexual assault is any unwanted sexual contact. Sexual assault can be verbal, visual or any act that forces a person to join in unwanted sexual contact or attention. It can happen in many different situations, such as by a stranger in an isolated place, on a date or in a home by someone you know.
Rape is a common form of sexual assault. It is committed in many situations - on a date, by a friend or an acquaintance or by a stranger when you think you are alone. Educate yourself on "date rape" drugs and how to avoid being a victim. "Date rape" drugs can be slipped into a drink when a victim is not looking. Never leave your drink unattended - no matter where you are. Try to always be aware of your surroundings.
The legal definition of sexual assault in Oklahoma involves three aspects:
- Sexual penetration, oral, vaginal, or anal, however slight.
- Force or threat of force, either real or implied.
- Lack of consent - Silence does not give consent and a person incapacitated by drugs or alcohol does not have the ability to give consent.
All three of these aspects must be present in Oklahoma to fit the legal definition of sexual assault. Nevertheless, even with all of these factors in place, not all sexual assaults can be proven and/or prosecuted.
